Terms of Service

Welcome to PhotoGenProMax. By using our service, you agree to these terms. Please read them carefully.

1. What We Offer

PhotoGenProMax is an AI-powered service that generates images based on photos you upload. You can create images of yourself in different outfits, poses, and settings.

Important: All generated images are AI-created, not real photographs.

2. Who Can Use This Service

  • You must be at least 16 years old
  • You must only upload photos of yourself, or have clear permission from anyone in photos you upload
  • You must not be prohibited from using this service by any applicable laws

3. Your Account

When you create an account, you agree to:

  • Provide accurate information
  • Keep your login credentials secure
  • Be responsible for all activity under your account
  • Tell us immediately if your account is compromised

4. Credits and Payments

How Credits Work

  • You purchase credits to generate images
  • Credits don't expire while your account is active
  • Credits cannot be transferred to other accounts
  • See our Refund Policy for refund details

Taxes

All payments are processed by Polar.sh, our Merchant of Record. They handle:

  • Payment processing
  • Tax calculation and collection (VAT, GST, sales tax based on your location)
  • Receipts and invoices

The price at checkout includes all applicable taxes. Your bank statement will show "Polar.sh" for charges.

5. Acceptable Use

Do NOT use this service to:

  • Create images of anyone under 18
  • Create sexual, violent, or hateful content
  • Create fake images to deceive people (deepfakes for fraud, misinformation, etc.)
  • Impersonate others or create fake identities
  • Upload photos of people without their permission
  • Harass, defame, or harm others
  • Violate any laws
  • Abuse, hack, or disrupt our service

Consent Requirement

Only upload photos of yourself. If you upload photos of others, you must have their explicit permission for AI image generation. You're responsible for getting proper consent.

6. Your Content and Generated Images

Photos You Upload

You own your original photos. We only use them to generate images for you — we don't store them after processing.

AI-Generated Images

You can use the images you generate for personal or commercial purposes, subject to these terms. However:

  • AI-generated images may have limited or no copyright protection under current law
  • We don't claim ownership of images you generate
  • We can't guarantee generated images will be unique or protectable

Our Service

PhotoGenProMax, including its design, technology, and AI models, belongs to us. You may not copy, reverse-engineer, or redistribute any part of our service.

7. No Guarantees

We provide the service "as is." We don't guarantee that:

  • The service will always be available or error-free
  • Generated images will meet your expectations
  • Results will be consistent or perfect

AI has limitations. Generated images may have artifacts, errors, or unexpected results.

8. Limitation of Liability

To the extent permitted by law:

  • We're not liable for indirect damages like lost profits, lost data, or business interruption
  • Our total liability is limited to the amount you've paid us in the past 12 months, or $100 USD, whichever is greater

Some jurisdictions don't allow these limitations. In those cases, our liability is limited to the maximum extent permitted by local law. Nothing here limits liability for fraud or anything that can't be limited by law.

9. Your Responsibility

You agree to take responsibility for:

  • Your use of the service
  • Content you upload or generate
  • Ensuring you have consent from anyone in photos you upload
  • Any violations of these terms or applicable laws

If someone brings a claim against us because of your actions, you agree to cover our costs and damages.

10. Account Termination

By you: You can delete your account anytime by contacting us.

By us: We may suspend or terminate your account if you violate these terms or if required by law.

Upon termination, you lose access to your account and any unused credits (unless local law requires otherwise).

11. Disputes

If you have a problem, please contact us first at support@photogenpromax.com. We'll try to resolve it.

These terms are governed by the laws of Vietnam. However, this doesn't override any consumer protection rights you have in your own country that can't be waived.

12. Changes to Terms

We may update these terms. We'll post changes here and update the date. For major changes, we'll notify you by email. Continued use after changes means you accept the new terms.
